These are the terms of use of onaswing while the service is free. They are written to be understood on the first read; if something grates, write to us.
What this is, and what it is not
onaswing is a technical analysis tool for the S&P 500. On each market session it applies a rulebook defined in advance to those companies and emails you the ones that meet it, grouped by sector.
It is not financial or investment advice, it is not a recommendation to buy or sell any security, and it is not personalised: the rulebook is the same for everyone and onaswing knows nothing about your situation or your portfolio.
Investing carries the risk of losing money, and a rulebook having worked in the past does not guarantee it will work in the future. What you do with the list is your decision and your responsibility.
Who can sign up
People of legal age, for personal use. An email address is enough; nothing else is asked for.
What is delivered, and what is not promised
One report for each US market session, Tuesday to Saturday, in the language you choose. When the US market is closed for a holiday there is no session, and then there is no report either.
No delivery time and no continuous availability are promised. Market data comes from third parties and it can arrive late, arrive broken or not arrive at all; when that happens onaswing warns you instead of sending a doubtful list. Nor is that data guaranteed to be free of errors.
onaswing may change the service, pause it or close it. If it is something that affects you, it will tell you by email in advance.
The places and the waiting list
The launch is free for a limited number of places, which onaswing sets and can widen. When they are taken, whoever asks joins a waiting list and is notified in order of arrival. A place is not reserved, not bought and not transferred.
How the service is funded
onaswing is free and today the report carries no advertising. The way it is meant to be funded in the future is advertising, not charging a subscription for a report that is the same for everybody.
If there are ever ads, they will be labelled as advertising and kept apart from the report, so that they cannot be mistaken for the stocks that meet the rulebook. And one thing does not change with them: the user's email is never sold or handed to any advertiser.
Your account
You log in with a single use link onaswing sends to your email, with no password. Look after that mailbox: whoever can reach it can get into your account. If you lose it, you lose access, and the way out is to sign up again with another address.
You can cancel whenever you want from your account, immediately and with no explanations.
What is asked of you in return
That the report is for you. You can show it to whoever you like and quote the source with a link, but not resell it, not publish it as your own and not build a service on top that redistributes it.
And that you do not push the machine: no programs that automate signups, cancellations or bulk requests.
Who owns what you see
The texts, the design, the charts and the way the report is presented belong to onaswing. The market data they are based on belongs to its sources, and company names and trademarks belong to their owners.
Liability
As far as the law allows, onaswing is not liable for the investment decisions you take or the losses you incur, nor for failures, delays or interruptions of the service. None of this cuts back the rights the law gives you as a consumer.
If these terms change
They carry their version and their date at the top. If something relevant changes, onaswing tells you by email before applying it. If it does not work for you, you can cancel.
